  2. Types of Sick / Personal Leave • State sick leave accumulated prior to the 1995-1996 school year. • Local sick leave. • State personal leave. • Local extended sick leave. • Sick leave pool.

  3. State Sick Leave • Accumulated prior to May 30, 1995. • Accumulates and transfers from one district to another. • First leave used for: • personal illness, • illness in the immediate family, • family emergency, or • death in the immediate family.

  4. Local Sick Leave • Full-time employees earn five days of local leave per school year, at a rate of one-half a workday for each 18 workdays of employment. • Accumulates to a maximum of 60 days. (Those with over 60 days are “grandfathered”.) • Does not transfer if you terminate your employment with ECISD.

  5. Local Sick Leave • Upon retirement from ECISD through the Teacher Retirement System, accumulated local sick leave will be paid at the current daily rate of a certified substitute. (Maximum 60 days) • Second tier of leave used for: • personal illness, • illness in the immediate family, • family emergency, or • death in the immediate family.

  6. Local Sick Leave • May also be used for first-year care following the birth or adoption of an employee’s child, or placement of a child with the employee for foster care.

  7. Medical Certification for Sick Leave • An employee absent for more than five consecutive workdays because of: • personal illness, or • Illness in the immediate family shall submit medical certification of the illness. • Medical certification shall be made by a health care provider.

  8. State Personal Leave • Each employee earns state personal leave at the rate of one-half workday for each 18 workdays of employment, up to a statutory maximum of five workdays annually. • Accumulates and transfers from one district to another. • Third tier of leave used for: • personal illness, • illness in the immediate family, • family emergency, or • death in the immediate family.

Non-discretionary Used for the same reasons and in the same manner as state sick leave and local sick leave: personal illness, illness in the immediate family, family emergency, or death in the immediate family Discretionary Taken at individual employee’s discretion, subject to limitations: must be requested, limited duration, and schedule limitations. Types of State Personal Leave

  10. “Discretionary” Personal Leave Limitations • A written request must be submitted to immediate supervisor at least three days in advance. • May not be taken for more than three consecutive days. • May not be taken: • On the day before / after a school holiday; • Days scheduled for end-of-semester exams; • Days scheduled for state-mandated assessment tests; or • Professional or staff development days.

  11. Local Extended Sick Leave • When personal illness or disability, including pregnancy-related disability, extends beyond the number of accumulated sick days available, the employee shall receive his or her regular salary less the substitute pay (whether or not a substitute is employed) for a period of 20 days.

  12. Sick Leave Pool • The District permits sick leave pools to be established for employees according to District guidelines.

  13. Sick Leave Definitions

  14. Immediate Family • Spouse. • Son or daughter, including: • a biological, adopted, or foster child, • a son- or daughter-in-law, • a stepchild or legal ward, or • a child for whom the employee stands in loco parentis.

  15. Immediate Family • Parent, stepparent, parent-in-law, or other individual who stands in loco parentis to the employee. • Sibling, stepsibling, sibling-in-law. • Grandparent and grandchild. • Any other person who may be residing in the employee’s household at the time of illness or death.

  16. Family Emergency • Shall be limited to disasters and life-threatening situations involving the employee or a member of the employee’s immediate family.

  17. Other Issues • Employees are charged leave as used even if a substitute is not employed. • Leave is recorded in whole workdays and half workdays. • Paid leave for the current year is available for use at the beginning of the school year, but shall not be approved for more workdays than have been accumulated in prior years plus the ten days to be earned during the current year.

  18. Other Issues • When an employee who has used more than he or she has accumulated ceases to be employed by the District, the cost of the unearned leave days are deducted from the employee’s final paycheck.

  19. Temporary Disability • All full-time employees are eligible for temporary disability leave. • The maximum length of temporary disability leave shall be 180 calendar days.

  20. Court Appearances • Absences for court appearances related to an employee’s personal business shall be deducted from the employee’s leave or, at the option of the employee, shall be taken as leave without pay.

  21. Other Types of Leave • Family Medical Leave • Leave of Absence • Assault Leave • Federal Leave for Military Service • State Leave for Military Service • Compliance with a Subpoena • Jury Duty • Developmental Leave of Absence
