Responsibilities • Commanders • - EO Officer for their command • - Develop and implement EO Program • EO Advisors (EOA) • - Act as the eyes and ears for the commander • - Assist the commander in implementing a • Consideration for Others Program • - Assist commanders in assessing, planning, • implementing and evaluating the EO Program • - Conduct training
Responsibilities • EO Representative (EOR) • - Assist commanders at Bn- level or equivalent • and below in carrying out the EO Program • - Establish and maintain liaison with other (EORs) • and with the EOA at higher headquarters • - Assist complainants by referring them to the • appropriate agency for assistance • - Assist the commander in conduct of EO Training
Responsibilities • Complainant • - Attempt resolution • - Advise the commander • - Submit legitimate complaints
Types of Complaints • Informal: • - Not normally in writing on DA Fm 7279 - R • - No timelines or suspenses • - Address complaint with urgency as formal • - MFR for good measure • - Complainant can resolve him or herself • - Not necessarily reportable • - May not be necessary to involve commander
Types of Complaints • Formal: • - Filed on a DA Form 7279-R • - Complaints may be filed with the following • people/agencies: Chain of Command; EOA; IG; • HRO; SJA; MP/CID; Chaplain; Medical Agency • - Filed 60 days from date of incident(s) • - After 60 days, may be pursued at Commander’s • discretion
Formal Complaint Process • Commander receives complaint: • - Administer oath on DA Form 7279-R • - Three days to act on complaint, except for those filed • with the IG • - Conduct an inquiry himself/herself or appoint a a 15-6 • Officer to conduct inquiry • - Commander/Investigating Officer has 14 calendar • days to investigate and discuss outcome with victim. • A 30 day extension may be granted from the next • higher commander if required.
Formal Complaint Process • Commander receives complaint (cont): • - Further extensions may only be granted by the first • GO in the Chain of Command. • - Commander takes appropriate action based on • findings
Appeals and Follow-up • Appeals: • - Within 7 calendar days • - Must be in writing • - Three days for referral and 14 days to complete • - Final decisions on complaints rest with the General • Court-Martial convening authority • Follow-up: • - EOA conducts an assessment • - 30 - 45 days after final action • - To assess complainant’s satisfaction
