  2. Purpose of this Session For construction firms, subcontractors, and suppliers: …to better understand State System and University organization, projects, and contract opportunities

  3. Act 188 of 1982, Enabling Legislation • System considered a “State-affiliated” organization • Authorized to execute and administer contracts for construction, repair, renovation, and maintenance projects, except capital projects • Must comply with Commonwealth statutes

  4. The Universities 14 universities: • 110,000 Students • almost 900 buildings Universities… • have professional facilities and contracting staffs • operate “independently”

  5. At the Office of the Chancellor Assistant Vice Chancellor for Facilities, provides: • project funding policies and approvals • other facilities functions Construction Support Office, provides: • policy, guidance, and oversight of facilities procurement • coordination, advice, and assistance to universities • review of contract disputes (bid protests, claims)

  6. Project Funding Sources • Commonwealth Funded Commonwealth Capital projects (for E&G facilities) • University Funded University capital projects University auxiliary facilities (self-supporting activities) Smaller renovation/maintenance projects • Special Projects student housing others

  7. What does this mean for firms? Department of General Services (DGS) • advertises for and bids Commonwealth-funded projects Universities • advertise for and bid university-funded projects • may advertise for and hold job order contracts System/CSO • does not procure or administer construction

  8. What about upcoming bids? DGS IFBs for PASSHE projects: • in FY14/15 – up to 6 projected • advertised on PA eMarketplace University IFBs: • IFBs for numerous projects • advertised on PASSHE eProcurement Exchange System/CSO: • nothing

  9. What about CM and Commissioning? Department of General Services: • open AFQs for CM and Commissioning • uses their own firms/contracts for projects they administer Universities: • typically do not procure CM and Commissioning services; utilize System/CSO contracts System/CSO holds open-end contracts: • 26 open-end CM contracts awarded in 2013 • 6 open-end Commissioning contracts, and will issue an RFP in 2015 for new contracts

  10. Advertising, Bidding, and Award IAW the Commonwealth Procurement Code • public notice • low bid No prequalification list Other Commonwealth statutory requirements: • performance and payment bonds • separate primes • prevailing wage and eVerify • Steel Act, etc.

  11. SB and SDB Considerations DGS: • requires SDB participation as subcontractors/suppliers • has an SB set-aside program for construction System and Universities: • require SDB participation as subcontractors/suppliers • do not have an SB set-aside program for construction
