  2. Objectives • Purpose of Civil Rights Review process within Career and Technical Education; • Laws applicable to a Civil Rights Review; • Learn how LEAs are selected for a Civil Rights Review; • Walk through the Civil Rights Review process;

  3. Purpose of civil rights review • Each state agency must establish and identify a Methods of Administration (MOA) coordinator to monitor civil rights compliance with the local education agencies (LEA) that provide Career and Technical Education (CTE) and receive federal financial assistance. • Office of Civil Rights guides and monitors the state MOA coordinators in the implementation of mandated MOA guidelines and activities.

Laws • Title IV of the Civil Rights Act of 1964 • Prohibits discrimination on the basis of race, color or national origin • Title IX of the Education Amendments of 1972 • Prohibits discrimination on the basis of sex • Section 504 of the Rehabilitation Act of 1973 • Prohibits discrimination on the basis of disability • Age Discrimination Act of 1975 • Prohibits discrimination on the basis of age

Laws • Title II of the Americans with Disabilities Act of 1990 • Prohibit disability discrimination by public entities, whether or not they receive federal financial assistance • Boy Scouts of America Equal Access Act • Prohibits discrimination against any group officially affiliated with the Boy Scouts of America or any other youth group listed in Title 36 of the US Code as a patriotic society

  6. Why was my lea selected? • Comparisons were made using the total LEA enrollment and total CTE enrollment to identify potential disproportionate enrollment in the following areas: • Race/ethnicity • Sex • Disability • Total enrollment • Limited English proficiency • Last year of on-site review

Why was my lea selected? • A ranking system was used applying the highest number of points to those areas of disproportionate enrollment. • LEAs are selected based on the highest number of points received. • Based on the number of LEAs in North Carolina, we are required to review six LEAs every two years (three per year).

  9. process • LEA submits a Voluntary Compliance Plan (VCP) • Addresses the non-compliance issues on LOF • Civil Rights Coordinator monitors LEAs progress of VCP • During the Civil Rights Review process, Civil Rights Coordinator works closely with the LEA’s CTE Director.
