Post-FSP World • A) Amendments • Signing Matrix for co-holder FSPs • Who signs for the agreement holder(s)? • Who signs for the professional preparing? • Submission formats? Sequential #? • Types of amendments? • New FSP Tracking System (March 31/07)
Post-FSP World • Amendments (cont’d) • 1) Declared areas (company RPF, & at least one FSP partner – Woodlands or Operations Mgr) • 2) Amendments not requiring approval – no text changes (same as above) • 3) Amendments not requiring approval - text changes (same as above) • 4) Amendments requiring DDM approval (RPF, & all FSP partner signatures)
Post-FSP World • Amendments (cont’d) • Option 5: “Amendment submitted to, & approved or acknowledged by, approving District with lead from the most affected District. • However, with agreement of the approving District, the most affected District would be allowed, in some cases, to approve the amendment.”
Post-FSP World • B) Land Use Orders • Provincial Non-Spatial Old Growth Order • Applies to both TFLs (& a CFA) in PGFD • ILMB sets the targets by NDT/BEC zone • No clear mechanism to amend the Order • Recruitment strategies for any deficient zones are to be approved by MOFR DDM
Post-FSP World • Land Use Orders (cont’d) • Prince George TSA Biodiversity order • Defines old growth, old interior & young patch size distribution targets for merged BEC units • Administered by a consortium of Licensees • Voluntarily report out once a year; follow a non-legal implementation policy • No spatial definition of OG patches
Post-FSP World • Land Use Orders (cont’d) • Closely allied is stand level biodiversity • Can it be “strategically located” vrs randomly scattered across the landscape? • One TFL FSP argued successfully that retention should focus on known biodiversity priorities & locations • The term “stand level” in FRPA need not be block specific
Post-FSP World • C) Exemptions • What are the mechanisms for variances or exemptions (e.g. visuals)? • Exemption only - FPPR 12(7)? • Exemption & FSP amendment? • Amend VQOs via GAR Order; no FSP amendment? • Lots of increasing pressure for exceptions in the MPB salvage polygons
Post-FSP World • Other Issues • No batch fix for setting up FSP SSIDs in RESULTS • RESULTS reporting is legislated; the ESF is policy only; C&E implications? • Can FL operating areas be redirected at the Forest Act/TSA level; what will this do for FRPA FDUs? • Will “materiality” ever be legally defined? • Without cut block plans, how do we ensure appraisal allowances are included in CPs to mitigate natural range barrier impacts?
