When considering the child’s capacity a tribunal shall consider a number of factors, which include: • the child’s age and stage of learning • the child’s practical understanding of the particular right s/he is seeking to exercise • the extent to which the child appears to understand the consequences of exercising the particular right at the particular time • the child’s level of achievement and ability to understand core learning in relation to literacy and numeracy • the views of the child in relation to the particular right • the views of the child’s parent in relation to the particular right • the views of the child’s class teacher, support teacher or pastoral teacher who knows the child well

Where did the idea come from? • From 12th January 2018, children aged 12-15 can now raise new types of references to the Tribunal. • The President set out a clear vision to create an empowering online resource that would feel like a helping hand to children. It had to be a welcoming, relaxed, informative resource that could be easily understood.

  11. Design • The team of people that worked on the design of the website included the President, SCTS staff, members of the Tribunal and the design company, Studio LR. • The team was extended to include children through the testing phase.

  12. How did we start? We worked with Studio LR to agree what we needed: • A new original name for the service which should also act as a standalone URL. • A new visual language to be used as a visual aid both online and in print. • Design of an accessible website aimed at 12-15 year old children with additional support needs. • User testing – including building of a prototype.

  13. Needs to Learn? • The team worked to create a unique name for the service. • We decided on Needs to Learn. • We felt that everyone needed to learn throughout the Tribunal process. Children need to learn, teachers need to learn, Tribunal members need to learn about etc… • Logo: • Website URL: www.needstolearn.scot

Visual Language • The President’s vision was to have a set of unique imagery that can be used to identify the Additional Support Needs Tribunal and be used as a tool to assist children with communication throughout the process. • These are also to be featured across the needs to learn website and on all forms and guidance for children.

  21. Testing • The President invited a small group of children of various ages and abilities to test the design. • The Young Ambassadors also got to see the website and had an opportunity to influence design.

  22. My Voice “I liked having an input into the design of the Needs to Learn website and giving my ideas, as I know this will benefit the children who will use the website. I also enjoyed visiting the Tribunal and meeting the President. This gave me an understanding of the work carried out by the Tribunal. I would like to be a Tribunal member in the future” Devlin, Aged 12

  23. My Voice “Thank you for asking me to be involved in the testing of the children’s website. It was very interesting to meet the President of the Tribunal and other staff. It can be scary meeting with adults sometimes, but Mrs Dunsmuir was lovely and listened to what I had to say. I also enjoyed working with Kimberley, the designer, who asked me lots of questions about what I thought of the website. I would like to take part again!” Kerrie, Aged 15

  24. Feedback The website has been live for 4 months now. We have received feedback from a number of people: “I really like the style. It is professional and not condescending yet achieves, I think, effective communication . The ‘word meanings’ section is particularly inspired.” Lady Smith, President of Scottish Tribunals. “I have had a look at this resource as suggested – it is excellent and a very helpful and easy to understand guide for anyone – not just young people!” Mary McLuskey – Project Manager

  25. The Future • The team will continue to consider ways to improve accessibility on the website. • Characters and symbols now appear across Tribunal documentation and communications. • Extend to under-12’s?

Tribunal Patterns and Statistics Claims Received: In 2017/18, 11 claims were made in the reporting year, representing an increase of 2 compared to the previous year. • 1 claim was made on exclusion • 1 claim was made on exclusion and another issue to do with education • 1 claim was made on admission, exclusion and another issue to do with education • 8 claims were made on the matter of another issue to do with education

  42. Tribunal Patterns and Statistics Claims Received: Of these: • 1 claim was withdrawn following a change of mind by the appellant • 1 claim was withdrawn for another reason • 1 claim was dismissed under rule 18 • 8 claims remain outstanding.
