Program Discrimination Complaints Complaints filed by persons, organizations or companies, alleging discrimination in a program or activity either conducted or assisted by APHIS. This includes complaints filed against recipients (cooperators/grantees) of Federal financial assistance from APHIS.
Authority • Departmental Regulation 4330-2: Ensure compliance with and enforcement of the prohibition against discrimination in programs and activities funded in whole or in part by the Department • Departmental Regulation 4330-3: Ensure compliance with and enforcement of the Department’s prohibitions against discrimination in its conducted programs and activities. • Both regulations specifically address: Processing administrative complaints of discrimination filed with the Department in any program or activity conducted by USDA.
Purpose • Ensure that APHIS and its recipients are in compliance with Departmental Regulations. • Complaints against APHIS/recipient personnel or programs alleging or inferring discrimination or unfair treatment in program delivery or activity must be forwarded to USDA’s Office of the Assistant Secretary for Civil Rights (ASCR) office for processing.
Receiving Program Complaints • If any APHIS employee receives a verbal complaint, that employee should advise the complainant to contact ASCR’s Office of Adjudication (OA) at the following address: USDA, Director, Office of Adjudication 1400 Independence Avenue, SW, Washington, DC 20250-9410 1 (866) 632-9992 (toll-free)/(202) 401-0216 (TDD)/(202) 720-8046 • If any APHIS employee receives a written complaint, that complaint should be faxed immediately to CREC for review at: USDA/APHIS/OA/CREC Attn: Steve Shelor, Assistant Director Room 1137 South Building, 1400 Independence Avenue, SW Washington, DC 20250-3436 (202) 720-0010 (phone)/ (202) 720-2365 (fax) • You must continue to provide the complainant with whatever program services he or she would normally be entitled to from the agency. • Record the circumstances of the complaint as soon as possible following the complaint; CREC may request a status report.
Processing Program Complaints • OA is the office responsible for formally processing program complaints. • Inquiries or discussions with the complainant regarding the processing of the complaint should be between the complainant and OA, not APHIS personnel. Refer any such inquires from the complainant to OA. • All program complaints of discrimination against USDA agencies and/or their recipients must be forwarded to OA within five days of their receipt by the agency.
