  1. BILLY BALDWINUCATT REGIONAL SAFETY ADVISER CONSTRUCTION INDUSTRY Health & Safety from the front line Adelphi Hotel Liverpool 22nd May 2012

  2. Introduction • Regulations • 1977 & 1996 • Consultation • Safety Reps & functions • Case Studies • Safety Committees etc

  3. Regulations The Safety Representatives and Safety Committees Regulations (SRSCR) 1977 The Health and Safety (Consultation with Employees Regulations) 1996 All employers are required to consult their employees on health and safety matters

  4. Consultation Our view with regard to consultation is that it is possible for an employer with up to five employees to consult with their employees directly. However when the number of employees reaches above five it becomes increasingly difficult to engage in meaningful consultation with employees directly. We believe at this level it is prudent for employers to consult their workforce through well trained and knowledgeable safety representatives. This is in line with the current requirement for employers to produce written policies and assessments when they employ five or more people.

  5. HSE say… “Consultation involves employers not only giving information to employees but also listening to and taking account of what employees say before they make any health and safety decisions.” HSE INDG 232
