  2. IMPLEMENTING INSTRUCTIONS FOR DESIGNATING DEATH GRATUITY RECIPIENTS ON THE DD FORM 93 REFERENCES: AR 600-8-1, DTD 30 APR 07 MILPER MSG 07-186, 24 JUL 07, ALARACT MSG 026/2008

  3. OVERVIEW: The Army Casualty Program depends upon the DD Form 93 having accurate, up–to–date information. This extremely important form, designates beneficiaries for certain benefits in the event of a Soldier’s death. It is a guide for the disposition of that Soldier’s pay and allowances if captured, missing, or interned. It also indicates the name and address of the persons the Soldier desires to be notified in case of emergency or death. The DD Form 93 for all Active Army Soldiers is stored on EMILPO database and available for retrieval with authorized access.

  4. Importance of DD Form 93 This form is extremely important because— a. When completed, it becomes an official and legal document that designates the beneficiaries of certain benefits in the event the individual is in a missing status or deceased. b. It provides the name and address of the persons to be notified in case of an emergency, sickness, or death.

  5. Preparation, Review, Update, and Disposition of DD Form 93

  6. Preparation of DD Form 93

  7. Agencies preparing the DD Form 93 will ensure that— • They submit a new, signed and authenticated, completed form when there is a change in any one of the items, except unit. • (2) They do not staple, fold, punch holes, or mutilate the • completed form (original copy) for transmittal to CDR, • AHRC (AHRC–PEZ). • (3) Members carefully read and fully understand the instructions and the statement before they sign in ink. • (4) Members complete any item that is the same as a previous entry by repeating the name and entering “SEE ITEM ....” • The preparing activity may require individuals filling out the form to present documented evidence of marriage, divorce, birth of family member, adoption of a family member, or any other significant change.

  8. Review of DD Form 93

  9. Active Army Soldiers will review the form— • During out–processing for permanent change of station (PCS) and pre–separation processing. • (2) Upon arrival at a new duty station. • (3) During any record audit. • (4) In conjunction with Soldier Readiness Program (SRP). • (5) Annually, in their birth month. Soldiers may accomplish this • requirement in conjunction with any of the above.

Reserve Component (USAR and ARNG) Soldiers will review the form— • During in–processing to a new troop program unit (TPU). • (2) In conjunction with a nationwide deployment or MOB readiness exercise. • (3) Annually, in their birth month. Soldiers may accomplish this requirement in • conjunction with (1) or (2), above.

All DA civilians assigned to emergency essential (EE) positions, and all civilians deploying in support of military operations will complete or review the DD Form 93 as follows— • Upon acceptance of assignment to a position designated as EE and annually while in that position. • (2) Prior to departure from home station en route to CRC or other central processing • facilities. • (3) In conjunction with an emergency deployment readiness exercise (EDRE). • (4) During out–processing for PCS to an overseas assignment and annually while in • the overseas area. • When reviewing, the person will enter the date of the review in pencil below item 16 (date signed) of the paper copy of the DD Form 93 filed in the local personnel record.

  12. Update DD Form 93

  13. A new form is prepared when— • There is a change in any item, except unit. • (2) Five years have elapsed since the latest form • was submitted, or 5 years will have elapsed • since the last regular annual review. • This 5–year criterion applies only to Soldiers on active duty and DA civilians whose original DD Form 93 is maintained at CMAOC.

  14. Distribute DD Form 93

  15. Prepare the DD Form 93 in accordance with table 11–1 and distribute in accordance with table 11–2, AR 600-8-1. Within 2 working days of the casualty’s death, remove the DD Form 93 from the local personnel records, make a copy for the local personnel file and forward the original by mail to CDR, AHRC (AHRC–PEZ), 200 Stovall Street, Alexandria, VA 22332.

  16. MILPER MSG 07-186 DTD 24 JUL 07

  17. EFFECTIVE 25 MAY 07, SOLDIERS MAY DESIGNATE ONE BENEFICIARY (AND ONLY ONE BENEFICIARY) TO RECEIVE UP TO 50 PERCENT OF THE $100,000 DEATH GRATUITY (DG) ENTITLEMENT. THIS DESIGNATION MAY BE SOMEONE NOT LISTED UNDER TITLE 10, SECTION 1477(A). SOLDIERS MAY ELECT TO DESIGNATE IN TEN PERCENT INCREMENTS, UP TO THE MAXIMUM OF 50 PERCENT. THE UNDESIGNATED PORTION OF THE DG WILL BE PAID TO THE SOLDIER’S LIVING SURVIVORS IN THE ORDER OF PRECEDENCE ESTABLISHED IN TITLE 10, SECTION 1477. IF NO BENEFICIARY IS DESIGNATED, THE FULL DG WILL BE PAID IN ACCORDANCE WITH TITLE 10, SECTION 1477. • 2.  EFFECTIVE IMMEDIATELY, PERSONNEL RECORDS WORK CENTERS WILL OFFER SOLDIERS THE OPPORTUNITY TO DESIGNATE A DG BENEFICIARY IN ACCORDANCE WITH THIS NEW LAW. • 3. THE SOLDIER’S DESIGNATION UNDER THIS NEW AUTHORITY WILL BE RECORDED IN ITEM 13 “CONTINUATION/REMARKS” UNTIL A REVISED DD FORM 93 IS DEVELOPED BY OSD.

  18. 4.  DD FORM 93S EXECUTED PRIOR TO 25 MAY 07 ARE STILL VALID. HOWEVER, BENEFICIARIES ERRONEOUSLY DESIGNATED ON A DD FORM 93 EXECUTED BEFORE 25 MAY 07 WILL NOT BE PAID PURSUANT TO REFERENCE A UNTIL THE SOLDIER COMPLETES A NEW DD FORM 93. EXAMPLE - A MARRIED SOLDIER EXECUTED A DD FORM 93 ON OR BEFORE 25 MAY 07, AND ERRONEOUSLY DESIGNATED THE DG RECIPIENT AS SOMEONE OTHER THAN HIS/HER SPOUSE IN BLOCK 9A. UNDER THE OLD LAW, DFAS WOULD IGNORE THIS DESIGNATION AND PAY $100,000 TO THE SPOUSE. IN THIS EXAMPLE, IF THE SOLDER WANTS THE IMPROPER DESIGNATATION TO BE VALID, THE SOLDER MUST EXECUTE A NEW DD FORM 93 IAW THE INSTRUCTIONS IN THIS MESSAGE. 5. THIS MESSAGE IS VALID UNTIL SUPERSEDED. * 1 JULY 2008

  19. ALARACT 026/2008 This ALARACT talks about a revision to DD Form 93, changes in Soldier options for designating beneficiaries for the death gratuity. Although a new version has been published an effective date for implementing the beneficiary designation options that are reflected on the new DD Form 93 has not been established. Until the Secretary of Defense establishes an effective date for the new provisions (anticipated 1 JUL 08), Soldiers and HR personnel should continue to use the previous version of the DD Form 93, on E-MILPO. Soldiers must continue to follow the beneficiary designation published in MILPER MSG 07-186.

  21. ON AND AFTER 1 JULY 2008 • SOLDIERS MAY DESIGNATE FROM ONE TO TEN PERSONS TO RECEIVE ALL OR A PORTION OF THE $100,000 DEATH GRATUITY PAYMENT. SOLDIERS MUST DESIGNATE AMOUNTS PAYABLE IN 10% ($10,000) INCREMENTS. IF A SOLDIER FAILS, AT ANY TIME, TO MAKE A DESIGNATION OR DESIGNATES ONLY A PORTION OF THE AMOUNT PAYABLE, DFAS WILL PAY THE AMOUNT OF THE DEATH GRATUITY NOT COVERED BY A DESIGNATION AS FOLLOWS: • TO THE SURVIVING SPOUSE OF THE SOLDIER, IF ANY; • (B) TO ANY SURVIVING CHILDREN; • (C) TO THE SURVIVING PARENTS OR THEIR SURVIVOR; OR • (D) IF NONE OF THE ABOVE EXIST, TO THE DULY APPOINTED EXECUTOR OR • ADMINISTRATOR OF THE ESTATE, FOR DISTRIBUTION TO THE ESTATE, IF ANY.

  22. REQUIREMENT FOR SPOUSAL NOTIFICATION EFFECTIVE 1 JULY 2008, THE ARMY IS REQUIRED TO NOTIFY THE SOLDIER'S SPOUSE IN WRITING WHENEVER A SOLDIER DESIGNATES A PERSON OTHERTHAN THE SPOUSE TO RECEIVE ALL OR A PORTION OF THE $100,000. THEREFORE, IF A MARRIED SOLDIER DESIGNATES ANOTHER PERSON IN ADDITION TO OR IN PLACE OF THE SPOUSE ON OR AFTER 1 JULY 2008, BDE/SEPARATE BN S-1s AND MPDs WITH SOLDIER RECORDS RESPONSIBILITY WILL PREPARE AND SEND A LETTER TO THE CURRENT MAILING ADDRESS FOR THE SPOUSE, AS PROVIDED BY THE SOLDIER, INDICATING THAT SOLDIER HAS MADE A CHANGE IN HIS OR HER DEATH GRATUITY BENEFICIARY ELECTION. BDE/SEPARATE BN S-1s AND MPDs WITH SOLDIER RECORDS RESPONSIBILITY WILL VERIFY THE SOLDIER'S SPOUSAL AND DEPENDENT INFORMATION IN DEERS DURING DD FORM 93 UPDATES.

  23. REQUIREMENT FOR SPOUSAL NOTIFICATION (CONT) COMMANDERS WHO HAVE SOLDIER RECORDS RESPONSIBILITY WILL ESTABLISH PROCEDURES TO ENSURE THAT THEIR S-1s AND MPDs ADHERE TO THE ABOVE REQUIREMENT EFFECTIVE 1 JULY 2008. DUE TO THE PENDING TRANSITION TO DIMHRS, HRC WILL NOT MODIFY EMILPO TO AUTOMATE THIS PROCESS. FURTHERMORE, DIMHRS WILL NOT HAVE AN AUTOMATED CAPABILITY FOR THIS REQUIREMENT UPON INITIAL CONVERSION TO THAT SYSTEM. C. HRC WILL PROVIDE BDE/SEPARATE BN S-1s AND MPDs WITH SOLDIER RECORDS RESPONSIBILITY THE FORMAT AND CONTENT FOR THE SPOUSAL NOTIFICATION LETTER BY SEPARATE MILPER MSG.

  24. INFORMATION THE GUIDANCE OF MILPER MSG 07-186 WILL REMAIN IN EFFECT UNTIL 1 JULY 2008. ANY DD FORM 93 DATED AND SIGNED PRIOR TO 1 JULY 2008 MUST COMPLY WITH THIS MESSAGE. DESIGNATIONS UNDER THE NEW DEATH GRATUITY BENEFICIARIES RULES PRIOR TO 1 JULY 2008 WILL BE INVALID.

  25. USE OF NEW DD 93 BDE/SEPARATE BN S-1s AND MPDs WITH SOLDIER RECORDS RESPONSIBILITY WILL CONTINUE TO USE EMILPO TO PREPARE AND UPDATE THE DD FORM 93 AT ALL LOCATIONS WHERE EMILPO IS AVAILABLE UNTIL THE ARMY TRANSITIONS TO DIMHRS. SOLDIERS WHO UPDATE THEIR DD FORM 93 ON EMILPO ON OR AFTER 1 JULY 2008 WILL CONTINUE TO USE THE PREVIOUS VERSION OF THE DD FORM 93, DATED AUGUST 1998. SOLDIERS MAY STILL DESIGNATE UP TO TEN BENEFICIARIES IN 10% ($10,000) INCREMENTS IN ITEM 9 ON THE AUGUST 1998 VERSION OF DD93. ITEM 9 WILL ACCOMMODATE UP TO TEN BENEFICIARY DESIGNATIONS.

  26. USE OF NEW DD 93 (CONT) ONLY AT LOCATIONS WHERE EMILPO IS NOT AVAILABLE, ON AND AFTER 1 JULY 2008 SOLDIERS SHOULD USE THE NEW DD FORM 93, DATED JANUARY 2008, WHICH IS RESIDENT ON THE ARMY PUBLICATIONS WEBSITE. IN ALL CASES WHERE THE SOLDIER UPDATES A DD FORM 93 OUTSIDE OF EMILPO OR WHERE THE SOLDIER APPENDS A CONTINUATION ATTACHMENT FOR ITEM 13 OF THE DD FORM 93, BDE/SEPARATE BN S-1s AND MPDs WITH SOLDIER RECORDS RESPONSIBILITY MUST SUBMIT THE COMPLETED AND VERIFIED DD FORM 93, WITH ATTACHMENTS WHEN APPLICABLE, TO THE SOLDIER'S IPERMS ACCOUNT.

  27. MODIFIED INSTRUCTIONS TO COMPLETE EMILPO VERSION OF DD 93 ITEMS 1 THRU 8. NO CHANGE; HOWEVER, REMEMBER TO INCLUDE PHONE CONTACT INFORMATION FOR ANY NOK LISTED AS APPROPRIATE. ITEM 9A. ENTER THE FIRST NAME(S), MIDDLE INITIAL(S), LAST NAME(S) AND RELATIONSHIP OF FROM ONE TO TEN INDIVIDUALS TO RECEIVE THE DEATH GRATUITY PAYMENT. DISREGARD THE NOTATION, "IF NO SURVIVING SPOUSE OR CHILD," WHICH WILL NO LONGER APPLY ON AND AFTER 1 JULY 2008. TO DESIGNATE A SPOUSE, A SOLDIER MUST ANNOTATE LINE 9A WITH SPOUSE'S NAME, ADDRESS AND TELEPHONE NUMBER. SEEK LEGAL ADVICE PRIOR TO NAMING A MINOR CHILD AS A BENEFICIARY. WHEN A MINOR CHILD IS A DESIGNATED BENEFICIARY WITH A COURT-APPOINTED LEGAL GUARDIAN FOR THE CHILD'S ESTATE (AS DISTINGUISHED FROM PHYSICAL CUSTODY), DFAS WILL REQUIRE A CERTIFIED COPY OF THIS APPOINTMENT ORDER FOR PAYMENT.

  28. MODIFIED INSTRUCTIONS TO COMPLETE EMILPO VERSION OF DD 93 ITEM 9B. ENTER BENEFICIARY'S(IES') FULL MAILING ADDRESS(ES) TO INCLUDE THE ZIP CODE(S) AND TELEPHONE NUMBER(S). ITEM 9C. SHOW THE PERCENTAGE PAYABLE TO EACH DESIGNATED PERSON. PERCENTAGES MUST REFLECT 10% INCREMENTS. IF A SOLDIER DESIGNATES TWO OR MORE BENEFICIARIES, THE SUM OF THE SHARES MUST EQUAL 100 PERCENT. IF THE SOLDIER NAMES MORE THAN ONE BENEFICIARY WITHOUT ENTERING A PERCENTAGE SHARE FOR EACH BENEFICIARY, DFAS WILL MAKE PAYMENT IN EQUAL SHARES TO THE PERSONS NAMED. ITEMS 10A THRU C. NO CHANGE. ITEM 11. NO LONGER APPLICABLE IAW REFERENCE A. ITEMS 12A AND B. NO CHANGE.

  29. MODIFIED INSTRUCTIONS TO COMPLETE EMILPO VERSION OF DD 93 ITEM 13. CONTINUATION / REMARKS. NO CHANGE HOWEVER, AS A REMINDER: SOLDIERS MUST ENTER THE NAME AND RELATIONSHIP OF THE PERSON AUTHORIZED TO DIRECT DISPOSITION (PADD) OF SOLDIER'S REMAINS IN THE EVENT OF DEATH. IAW DODI 1300.18, DATED 8 JANUARY 2008, SOLDIERS MAY ONLY NAME ONE OF THE FOLLOWING PERSONS AS A PADD: o SURVIVING SPOUSE o A BLOOD RELATIVE OF LEGAL AGE o AN ADOPTIVE RELATIVE. IF NO ONE IN THESE THREE CATEGORIES EXISTS, THEN THE SOLDIER CAN NAME A PERSON STANDING IN LOCO PARENTIS. INCLUDE THE ADDRESS AND TELEPHONE NUMBER OF PADD.

MODIFIED INSTRUCTIONS TO COMPLETE EMILPO VERSION OF DD 93 IN ADDITION TO MAKING PADD DESIGNATION, THIS BLOCK OFFERS THE GREATEST AMOUNT OF FLEXIBILITY FOR THE SOLDIER TO RECORD OTHER IMPORTANT INFORMATION CONSIDERED EXTREMELY USEFUL IN THE CASUALTY NOTIFICATION AND ASSISTANCE PROCESS SUCH AS: o NOK LANGUAGE BARRIERS o EXISTENCE AND LOCATION OF A WILL o MEDICAL ATTENDANT POWER OF ATTORNEY o ADDITIONAL PRIVATE INSURANCE POLICIES o OTHER FAMILY MEMBER CONTACT NUMBERS. IF ADDITIONAL SPACE IS REQUIRED, ATTACH A SUPPLEMENTAL SHEET OF STANDARD BOND PAPER WITH THE INFORMATION AND ENSURE THE DD FORM 93 WITH ATTACHMENT IS POSTED TO THE SOLDIER'S ACCOUNT ON IPERMS. THE ARMY HAS EXPANDED THE SPACE ALLOTTED IN ITEM 13 FROM 300 CHARACTERS TO 1000 CHARACTERS SO THERE IS NORMALLY ENOUGH SPACE FOR SOLDIERS TO PROVIDE THEIR WISHES. ITEMS 14 THRU 16. NO CHANGE.
