  2. Phase 1 By July 1, 2009 System-wide: • 90% Reduction or 0.0080 lb mercury/GWhr Output Based Emission Rate, and Plant-wide: • 75% Reduction or 0.020 lb mercury/GWhr Output Based Emission Rate

  3. Phase 2 By January 1, 2013 Plant-wide: • 90% Reduction or 0.0080 lb mercury/GWhr Output Based Emission Rate

  4. Flexibility • Phase In of Controls • Averaging • Temporary Technology Option • Multi- Pollutant Option

  5. Temporary Technology-Based Standard (TTBS): • Available only to units that install appropriate mercury control. • The TTBS is available thru June 2015. • No more than 25 % of a company’s rated capacity may use the TTBS. • Units relying on the TTBS must have: • Activated Carbon Injection (ACI) • Must operate with at least at a minimum injection rate.

  6. Multi- Pollutant Standard (MPS) • Regulates Mercury, NOx and SO2 • Provides flexibility on mercury control in order to achieve significant NOx and SO2 reductions • Restricts Trading of Allowances that occur as a result of the MPS

MPS (cont.) • NOx • Seasonal Reduction: • January 1, 2012: Company-wide emissions must meet a Seasonal rate of: • 0.11 lbs/mmBtu or • 20% reduction, whichever is more stringent. • Annual Reduction: • January 1, 2012: Company-wide emissions must meet an annual rate of: • 0.11 lbs/mmBtu or • 48% reduction, whichever is more stringent. • SO2 • January 1, 2013 to 2014: Company-wide emissions must meet an annual emission rate of: • 0.33 lbs/mmBtu or • 56% reduction, whichever is more stringent. • January 1, 2015: Company-wide emissions must meet an annual emission rate of: • 0.25 lbs/mmBtu or • 65% reduction, whichever is more stringent.

MPS (cont.)SO2 and NOx Allowances:No trading of allowances generated by MPS: • May not purchase allowances to meet MPS requirements • May not sell or trade allowances, UNLESS those allowances represent reductions beyond the requirements of the MPS • Once In – Always In • Provides minimal "extra" revenue support for cost of additional controls.

  9. MPS Estimated Reductions • Total SO2 Reductions = 165,890 tons/yr • Total NOx Reductions = 28,779 tons/yr
