Borrow Pit Zoning Exemption Statute 84.06(12) Borrow Sites – Effective July 09 Intended to relieve highway Contractors from Lengthy and Uncertain Local Zoning Variance Process WisDOT Borrow Definition: “Traditional Borrow”, not including Materials Prepared, Processed and Tested for use as Base Course and Sub Bases. Exemption Only Applies to Site for Which Borrow is Excavated for Use in a Specific WisDOT Highway / Airport Project.

Borrow Pits, Cont.. • Statute Places Restoration Burden on Property Owner • WisDOT Still Requires Restoration Wis Stat. s. 84.06(2) and Std Spc 107.10 and 107.11. • ECIP Changes / Contractor Certification Requirements • Borrow Site is Near WisDOT Project • Owner has Consented to Site • Site Used Solely for Specified Project • Owner Agrees to Noise and Landscape Measures Required by Locals • Owner Agrees to Restore the Site • Valuable Tool, Don’t Abuse – Continue to Communicate with Locals
