Federal Policies Family Educational Rights and Privacy Act (FERPA)- Federal legislation in place since 1974- Protects student educational records as private: *Grades/Academic Progress *Financial Aid *Student Accounts *Conduct Records-Information cannot be released without written consent of student unless: *legitimate educational need to know *tax dependency *health and safety issue

Federal Policies Clery Act - Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act - Federal legislation in place since 1990- Requires all colleges and universities that participate in federal financial aid programs to keep and disclose information about crime on and near their respective campuses- Annual Campus Security Report published October 1st- Failure to report crimes can result inhefty fines from the federal government

Federal Policies Violence Against Women Act (VAWA)Campus Sexual Violence Elimination (SaVE) Act- Reauthorization of VAWA legislation in place since 2013- Campus SaVE legislation in place since 2014- Governs higher education institution responses to and prevention of: *sexual assault *domestic violence *dating violence *stalking

Federal Policies Title IX- Federal legislation in place since 1972- Prohibits discrimination on the basis of sex in any federally funded education program or activity- April 2011 “Dear Colleague Letter” provided guidance to colleges and universities regarding reports of sexual assault *duty to investigate and address reports of assault- April 2014: *White House Task Force on Sexual Assault Report *Dear Colleague Letter Q&A Report- Additional guidance on confidentialresources on college campuses

University Policies Code of Student Responsibility- University Policy 406- Applies to every student who has accepted admission- Governs student behavioral conduct inside and outside of classroom- Can be applied to off campus behavior- Overseen by Office of Student Conduct- Behaviors reported via online submission: * incidentreport.uncc.edu * by University Police, faculty, staff, other students- Attorney/Non-Attorney Advocate rights- Records protected by FERPA

University Procedures Campus Behavioral Intervention Team- “Niner Care Team”- Multi-divisional committee to address behaviors of concern and develop intervention plans *Dean of Students Office *Legal Affairs *Police and Public Safety *Counseling Center *Human Resources *Academic Affairs- Involuntary Protective Withdrawal Policy- Report an incident via incidentreport.uncc.eduor calling Dean of Students or PPS-Website resource: ninercare.uncc.edu

University Procedures Requesting Academic Accommodations- Students may seek assistance from Dean of Students Office (DSO)- Must provide documentation to support request- DSO reviews and verifies documentation- DSO submits a letter to faculty members requesting assistance in providing academic accommodations- Faculty members are the ultimate decision makers regarding whether or not to grant accommodations- Review by DSO is not required! *Faculty have authority to make accommodations without DSO

University Procedures Requesting Incompletes- Students may seek assistance from Dean of Students Office (DSO)- Must provide documentation to support request- DSO reviews and verifies documentation- DSO submits a letter to faculty members requesting assistance in providing Incomplete grades- Faculty members are the ultimate decision makers regarding whether or not to grant Incompletes- Review by DSO is not required! *Faculty have authority to grant Incompletes without DSO

University Procedures Withdrawal for Extenuating Circumstances -New Policy introduced August 2014UNC System-wide limit on Withdrawals-Applies to Undergraduate students only-Limits self Withdrawals to 16 credits -If W limit met, earned grade is assigned to student-Withdrawals for Extenuating circumstances are unlimited-Medical, Psychological, Personal Crisis, or Military circumstances-Academic policy states that the Dean of Students Office is responsible for procedure
