  1. Jail-Based Competency Restoration Senate Bill 1475, 83rd Legislature, mandates that DSHS create a jail-based competency restoration pilot. This pilot will include mental health or co-occurring psychiatric and substance abuse (COPSD) treatment services, as well as legal education for individuals found Incompetent to Stand Trial (IST), consistent with competency restoration services provided in state mental health facilities.

  2. Jail-Based Competency Restoration Senate Bill 1475 also mandates that DSHS appoint various stakeholders to serve on a workgroup to participate in developing and establishing rules for the pilot. In addition to the types of members required by the bill, members of the CAP, LANAC, and other advocacy groups will be included. A rough draft of the proposed rule for this pilot was already shared with the CAP and the LANAC and will be posted for public comment once (and if) a consensus is reached on the rules by the stakeholder workgroup.
