  8. Texas is a Delegated NPDES State EPA and TCEQ entered into an MOA that establishes responsibilities and expectations for TPDES permitting under the CWA • EPA delegated the NPDES program to TCEQ in 1998 • EPA retains oversight and ultimate authority

  9. WQD: Permits Texas Pollutant Discharge Elimination System (TPDES) Permits Issued to facilities that discharge directly to surface water. Texas Land Application Permit (TLAP) Authorizes the disposal of wastewater by evaporation, irrigation, and/or land application of sludge.

  10. WQD Permits Individual Authorizations Site-specific and technical review of the regulated activity General Permits One state-wide permit for similar types of activities; operate under terms and conditions of the general permit

  11. 401 State WQ Certification • U.S. Army Corps of Engineers 404 permits must be certified as meeting State Water Quality Standards • No net loss of wetlands • Persons affected by this program include but not limited to: • commercial navigation • transportation • retail or residential land development • private property developers • local, state, and federal infrastructure projects

  14. Concentrated Animal Feeding Operations(CAFO) • State regulations at 30 TAC 321 and the CAFO GP are currently being updated to be consistent with 2008 federal CAFO regulations • Terms of Nutrient Management Plans • Public Notice

  15. Temperature Limits EPA objecting to permits where temperature limits exceed water quality segment criterion. TCEQ is working with EPA to develop a state-wide protocol for developing/calculating temperature limits.
