Relationship CWMS & RMA Plans Committees of Council inform Give effect to plan provisions required consistent plan provisions influence
CWMS v RMA – What happens if they differ? • RPS and regional and district plans: • Must achieve purpose of the RMA; and • Comply with other statutory requirements, eg s32. • If action in RIP/ZIP cannot be done under RMA: • Use a non-statutory method; and • Be aware that statutory plans may allow a different outcome.
Regional Committee and Zone Committees • Regional Committee is a committee of Regional Council • Zone Committees are joint committees of RC and TA’s • Functions of committees set out in Terms of Reference • There is no hierarchy – different but complementary roles
Regional and Zone Committees cont… • Regional Committee • formulates a Regional Implementation Plan (RIP) • considers irrigation/storage options as part of regional infrastructure • regionally significant biodiversity projects • Other ‘water’ issues of regional significance or across zones • Zone Committee - informs Regional Committee on the above • implements non-regulatory local components of Regional Implementation Programme (RIP) • formulates Zone Implementation Programme (ZIP) and implements non-regulatory components
Committees & Applications • Regional and zone committees are committees of Council. • Therefore: • They can only act within delegated authority; and • They must not past comment on the merits of applications in the statutory planning process. • Why: Council is the decision-maker on these applications & the applicant & all submitters need to be assured the decision-maker is open-minded and not influenced by matters outside the statutory process. • CWMS Committees can influence this decision-making through participating in the development of the plans which applications are considered against, and helping shape applications before they are lodged.
Where to from here?Focus for the Zone Committee • Identify and address water quality; biodiversity; and water quantity issues in the Zone. • Develop Zone Committee’s position on water storage in zone to inform Regional Committee. • Provide input into statutory planning process where required: eg, water management plan for the Te Waihora/Ellesmere catchment
