2. Background
In previous years, both port operations and regulation of the maritime industry was vested in the Kenya Ports Authority.
In order to broaden and modernize the legal and institutional framework for the regulation of the maritime industry, the Government established Kenya Maritime Authority in mid 2004
Initially established under a legal notice the Kenya Maritime Authority Act became law in July 2006
The the Merchant Shipping Act was enacted in February 2009 and its gazetted commencement date was 1st September 09
3. Broad context of maritime regulatory mandate Total coastline 600 sq. km. excluding inland water like Lake Victoria, the second largest fresh-water lake in the world
Tourism and fisheries are major foreign exchange earners
Shipping has existed in Kenya in one form or another for centuries
Maritime transport accounts for 92% of carriage of international trade
4. Broad context of maritime regulatory mandate Port of Mombasa handles many hazardous and noxious substances (HNS) that pose a threat to the marine environment
Coastline adjacent to international shipping routes extensively used for the carriage of oil and other products.
Land based sources of pollution are increasingly becoming a major threat to the ecosystems both at sea and in the inland waters
Threat of pollution during bunkering and the discharging/loading of liquid cargoes and oils
Waste and chemicals from industrial, human and agricultural activities
5. Specific context of maritime regulatory mandate Development of capacity to maximize benefits in the supply and use of maritime transport services - a structured approach
Secure, market-driven and nondiscriminatory maritime transportation service system - free of unfair maritime trade practices and market distorting activities – essential for the growth of the sector
Structures to monitor efficiencies and competitiveness of a whole transport logistics supply chain – needed yesterday in view of numerous unresolved complaints
