Process – next steps • Assessment period includes - referral replies - expert advice • EPA decision expected before statutory deadline (2 January 2011) • Public notification of decision • Right of appeal to VCAT: 21 days after EPA decision

Best practice and project alternatives • Policies require operators “to apply best practice to the management of [their facility’s] emissions”. • “Best practice” focuses on the technical elements of each proposal rather than the broader alternatives to the proposal itself. • In this context, the proposal is for the production of electricity using brown coal (with some natural gas), using new technology not based on conventional brown coal technologies.
