  1. Electronic Quota for 50 + Employees Conditions and Procedures

What is Electronic Quota for companies having 50 and above employees? • A service offered by Ministry of Labour to companies having more than 50 employees (not including free zones). • Once approved, permits can be used in applying for New Work Permit. • Federal Law No. 8 1980 and UAE Cabinet Decree No. 259/1 for 2004 on Emaratization

  3. What are the Conditions? • The company is having 50 or more employees • The company must have clean track record and free of any violations. Such as: • a. No labour cards are expired for more than 2 months • b. WPS compliance • c. No pending labour disputes • or court cases

  4. What are the Conditions? • Sponsor or Local Service Agent must have clear file at MOL. Such as: • a. No licenses under his name is expired • b. No pending dispute with competent court or at MOL • c. Sponsor/ LSA must have an E-signature card • d. Sponsor/ LSA must have a single file at MOL • Must hire a UAE National

  5. What are the Required Documents? Copy of valid Trade License (partners list, commercial register if LLC) Passport copy of UAENational Copy of Jincia / Bitakat Almunshaa Passport copy of ExpatPartner/ Manager E-Signature CardCopy Establishment Card from Ministry of Labour (Labour Computer Card) Establishment Card from DNRD (Immigration Card) 3 Months Bank Statement Tenders or Contracts with clients/customers Valid Tenancy Contract (Not Google Map) Location map Utility Bills (DEWA/ETISALAT/DU) List of Employees Labour Contracts of all employees of the company

  6. The Ministry may also ask for the following: • Mulkiya or report from RTA about all company vehicles • If accommodation is provided in the labour contract, Tenancy Contract, Location map and picture of accommodation is required

  7. To add more credibility to your application you may present: • Company profile in English and Arabic • Report from Dubai Customs on how much worth of import/export your company did for a year • Completed projects (if contracting company) • International or Local Certifications

  8. Government Fees / ADAM Fees • Government Fees – 60 AED • ADAM FEES- 5,000 AED to 10,000 AED • PROPOSAL

Procedures Close the deal, set the expectation that we need the owner/ partner to apply for the electronic quota Collect all the documents and funds Scan all documents, create an order number, create a file and work flow (keep one file with you), submit to operations department Operations Department will type an application Once Application (1,2,3) is type the authorized signatory needs to sign and put the company’s official seal Arrange an appointment with operations and your client at the MOL to apply

  10. If Approved: • The number of E-quota that will be approved is based on the following criteria: • For Category A – 20% of the total number of employees • For Category B – 15% of the total number of employees • For Category C -10% of the total number of employees

  11. Labour Categories • Category A – 30% or less of employees are having same nationality • Category B – 31% to 74% of employees are having same nationality • Category C – 75% of employees are having same nationality • http://www.mol.gov.ae/english

If the Ministry will do an inspection: • If accommodation is provided MOL will check if the company is in compliance with safety rules, if the place is a conducive environment, of Man and Women are on separate quarters. • MOL might visit the office as well or warehouse. The company should keep an HR file which should contain list of employees, individual files of employees containing salary records, leave, holidays etc. • After such inspection and the approval will be based on the E-quota approval criteria

  13. If Rejected • The MOL will inform you of why it is rejected. • You can correct the issue and re-apply

  14. Fines • First Offense - After using the E-quota or applying for New Work Permit and 20 applications were incorrect the fines will be 10,000 AED and a labour block of 1 month • Second Offense - After using the E-quota or applying for New Work Permit and 10 applications were incorrect the fines will be 10,000 AED and a labour block of 2 months • Third Offense- After using the E-quota or applying for New Work Permit and 10 applications were incorrect the fines will be 10,000 AED and your labour file will be blocked indefinitely
