  2. BATA VZW - ASBLBelgian Air Transport Association Scope : International framework • Kyoto Protocol : global reduction of 5 % by 2012 in Greenhouse Gases emissions (GHG) from 1999 level. EU adopted 8 % reduction. • The Kyoto Protocol recognises the international nature of transport (maritime and air) by excluding it from targets and refering aviation to ICAO for actions on emissions. • ICAO guidelines expected at the next General Assembly in 2007.

BATA VZW - ASBLBelgian Air Transport Association Industry Emissions Containment Policy • Behaving as a responsible actor, the European industry adopted in 2005 its containment policy, based on the 4 pillars of a true balanced approach : - Technological progress - Infrastructure improvement (such as ATM) - Operational measures - Economic instruments (i.e. ETS)

BATA VZW - ASBLBelgian Air Transport Association E T S as economic instrument • Recognised by BATA and the industry as the best way forward. • Also supported by ICAO as delivering the best results. • Taxes and charges would simply drain of financial resources needed for investment, with nearly no benefits for environment.

BATA VZW - ASBLBelgian Air Transport Association A beneficial directive should: • Take into account that aviation is a growth sector when setting targets and caps. • Be aligned with the present regulation on ETS with regards to design elements (e.g. timeframe, auctioning, etc) • Follow ICAO guidelines • Avoid distortion of competition. In between particular care should be given to an appropriate geographical scope in order to ensure that all operators –EU and non-EU – are treated equally. • Not go together with taxes and charges that would constitute overlapping instruments. • Be a full open system and give full access to JI/CDM.

BATA VZW - ASBLBelgian Air Transport Association BATA concerns with the actual Commission proposal • A sound aviation climate change policy should not comprise economic instruments alone. • ETS cannot be combined with taxes and charges • Auctioning constitutes an additional cap and thus imposes an increased stringency on the aviation sector • The proposal baseline, based on 2004-2006 historical levels, must be adapted to avoid initial shortage. • Distribution of permits should not discriminate against or favour any particular type of operator or business model.
