  2. PRIMARY CARE SERVICES AND SVH DOMICILIARY FACILITIES VA is required to pay per diem to a State which provides "domiciliary care" to eligible Veterans in a State home. VA’s Office of General Counsel on March 21, 2014 issued an official opinion which affirmed that States must provide primary care to the State Home Domiciliary residents in order to receive per diem payments from VA.

  3. PRIMARY CARE SERVICES AND SVH DOMICILIARY FACILITIES This Official Opinion was disseminated in multiple ways. It was also placed on the public VA’s website-www.va.gov.

  4. PRIMARY CARE SERVICES AND SVH DOMICILIARY FACILITIES Ascellon surveyors will evaluate Domiciliary facilities for compliance with this Official Opinion. Domiciliary standard #181 is deficient if the surveyors find a State Home does not provide primary care to Domiciliary residents or does not have a sharing agreement in place for the provision of primary care.
